In response to the tragic death of Sophia Naismith, new driving laws have been enacted to ensure drivers who carelessly cause death or serious injury face appropriate legal consequences. The key elements of these laws include:

  1. New Offense for Careless Driving: This law introduces a new offense for causing death or serious harm through the careless use of a vehicle or vessel. An aggravated offense can lead to a penalty of up to seven years in jail, along with a license disqualification for a minimum of three years. For a basic offense, the penalty is up to five years in jail, with a license disqualification period of at least 12 months.
  2. Enhanced Police Powers: The laws empower police with greater authority to immediately suspend a driver’s license in cases involving serious crashes. This measure is intended to prevent further harm and ensure public safety while legal proceedings are underway.
  3. Restrictions on High Powered Vehicles: Drivers of ultra high powered vehicles are prohibited from disabling automated intervention systems. Violating this law can result in a hefty fine of up to $5,000. This is a step towards ensuring the safety features of these vehicles are always active to prevent accidents.

Further reforms are anticipated in 2024, including a new license class specifically for drivers of ultra high powered vehicles. These measures represent a comprehensive strategy to improve road safety and hold drivers accountable for their actions on the road.

The implementation of these laws marks a significant shift in road safety policy, aiming to reduce the number of tragedies on the road and ensure that justice is served in cases of reckless or careless driving.

Attorney-General Kyam Maher says that the Government is seed seeking to do “everything in our power to ensure that those responsible are brought to justice”

“The new offence will give authorities greater flexibility when considering charges against those whose careless behaviour has a devastating, irreversible effect on others.”

“At a time when our road toll is unacceptably high, these laws will send a clear message to all road users that we will not tolerate this kind of behaviour on our roads.”
